HOUSTON, Texas - Sutliff & Stout, a Houston-based personal injury law firm, has released guidance explaining how long a Houston car accident settlement may take and what factors can affect the timeline for injured individuals.

According to the firm, many Houston car accident settlements may take three to eighteen months, depending on injury severity, liability clarity, insurance coverage, medical documentation, and whether litigation becomes necessary. Simpler cases involving clear liability and documented injuries that have reached maximum medical improvement may resolve faster, while cases involving disputed fault, serious injuries, uninsured or underinsured drivers, or lawsuits may take longer.

The firm said one of the most important factors in the settlement process is maximum medical improvement, often referred to as MMI. This is the point at which a treating physician determines that the injured person's condition has stabilized or that additional treatment is not expected to produce significant improvement.

Houston-based car accident lawyers at Sutliff & Stout advise that settlement discussions should generally take place after medical treatment has progressed sufficiently to assess completed care, future medical needs, and documented treatment recommendations. Settling before reaching Maximum Medical Improvement (MMI) may create unnecessary risk, as future medical expenses, ongoing rehabilitation, pain management needs, lost earning capacity, or potential complications may not yet be fully understood.

The firm noted that once a settlement agreement is signed, the injured person typically releases future claims against the at-fault party connected to the accident. For that reason, settlement timing may affect whether a claim reflects the full medical and financial impact of an injury.

The guidance explains that Houston car accident settlement timelines often include three main stages: medical treatment, demand and negotiation, and litigation when needed.

During the medical treatment phase, attorneys may gather medical records, bills, diagnostic reports, physician opinions, and documentation related to future care needs. Soft tissue injuries may involve a shorter treatment period, while orthopedic injuries, surgery, rehabilitation, or traumatic brain injuries may require longer evaluation before a claim can be fully assessed.

After treatment is complete or MMI is reached, an attorney may prepare a demand package for the insurer. This package may include medical records, bills, wage loss documentation, liability evidence, and a calculation of damages such as pain, suffering, and loss of enjoyment of life.

The guidance also notes that Texas Insurance Code Section 542.055 addresses insurer acknowledgment and response obligations after receiving notice and documentation of a claim. Insurers may request additional information during the review process, and negotiation often continues through multiple rounds before a settlement is reached.

If the insurer's offer does not reflect the documented damages, the injured person may choose to file suit in Harris County District Court. Filing a lawsuit does not necessarily mean the case will go to trial, but it can introduce discovery, depositions, expert review, and a formal court timeline. In many cases, litigation may add twelve to twenty-four months depending on case complexity, court scheduling, and settlement discussions.

The firm's guidance identifies disputed liability as one of the most common causes of delay. If the other driver denies fault or claims the injured person was partially responsible, the insurer may reduce the settlement offer. Texas proportionate responsibility rules under Chapter 33 of the Texas Civil Practice and Remedies Code may affect recovery when fault is allocated among multiple parties.

Uninsured and underinsured motorist claims may also take longer because the injured person may need to pursue benefits through their own insurance coverage. Serious injuries may also extend the timeline because the full cost of treatment may not be known until the injured person completes medical care or reaches MMI.

The firm said several factors may help a claim move more efficiently, including clear liability evidence, prompt medical treatment, consistent follow-up care, complete medical documentation, wage loss records, repair estimates, photographs, witness information, and physician opinions about future treatment needs.

Sutliff & Stout said the purpose of the guidance is to help injured individuals better understand why settlement timelines vary and why early settlement can carry financial risk when the long-term effects of an injury are not yet known.
