Sets a Lead Plaintiff Deadline of November 16, 2026
Federman & Sherwood announces that on September 16, 2026, it filed a class action lawsuit in the United States (“U.S.”) District Court for the Northern District of Texas against Phoenix American Hospitality, LLC, a Delaware limited liability company (“Phoenix”), American Hospitality Properties REIT, Inc., American Hospitality Properties REIT II, Inc., and certain of its officers, Proven Business Skills v. Phoenix American Hospitality, LLC, et al. (Case No. 3:26-cv-03130). The Complaint alleges that Phoenix and certain officers made materially false and/or misleading statements and omissions in violation of the federal securities laws and seeks to pursue remedies under Sections 10(b) and 20(a) of the Securities Exchange Act of 1934 (the “Exchange Act”) and Rule 10b-5 promulgated thereunder throughout the Class Period, which is between March 1, 2022, and July 31, 2024 (“Class Period”). Following these materially false and misleading statements and/or omissions, SEC filings and subsequent disclosures revealed the truth of Phoenix’s operations and brought to light the falsities behind Defendants’ statements.
Plaintiff seeks to recover damages on behalf of all investors who purchased securities in American Hospitality Properties REIT, Inc., and/or American Hospitality REIT II, Inc., during the Class Period. You may move the Court no later than Monday, November 16, 2026, to serve as lead plaintiff for the Class. However, to do so, you must meet certain legal requirements pursuant to the Private Securities Litigation Reform Act of 1995 (PSLRA).
