On August 6, 2010, Advanced Environmental Recycling Technologies, Inc. (AERT) and Fort Mason Master, L.P. and Fort Mason Partners, L.P. (the Funds) agreed to dismiss, without prejudice, the pending lawsuit and the claims and counterclaims therein in conjunction with a sale by the Funds of their Series D preferred stock and warrants to a third party.
