VA Individual Unemployability Benefits Safe For Now

VA and congressional leaders have backed off the idea of limiting veterans to Social Security Disability or Individual Unemployability.
HOUSTON - Feb. 25, 2018 - PRLog -- Congress and the VA have backed off a plan that would have impacted Individual Unemployability and Social Security Disability benefits. One of the proposals would have made veterans only able to receive either Individual Unemployability benefits or Social Security Disability benefits.

No formal bill was written after veterans groups and VA Disability compensation lawyers balked at the idea of cutting Individual Unemployability benefits. Once congressional leaders heard from veterans' advocates and their lawyers, there were no changes to the VA's Individual Unemployability requirements or income limits.

The proposal would not have affected veterans that receive a 100% VA Disability rating and Social Security Disability.The proposal would also not have affected veterans with a 100% VA disability rating for PTSD or other mental conditions. There was chatter about PTSD changes, but that never happened, and PTSD VA Disability benefits claims were not affected.

One recent change is that the 2018 VA Disability rates have increased. Veterans that are receiving Individual Unemployability will see a moderate rate increase. You can see your new compensation rate by viewing the Individual Unemployability fact sheet.

The VA has also implemented its Rapid Appeals Modernization Program (RAMP). So far, many veterans advocates groups and veterans disability benefits lawyers are advising clients not to opt-in because one new track will limit your ability to submit new evidence. One reason many clients are successful with VA Benefits appeals lawyers is because the attorney knows what evidence to use to win their claim. Because one new RAMP track limits evidence, many veterans groups and lawyers are currently steering clear.
