Terex Corporation (the “Company”) issued a press release on August 12, 2009, announcing that the previously announced agreement in principle it has reached with the Staff of the United States Securities and Exchange Commission (the “Commission”), has now been approved by the Commission, which is subject to court approval. A copy of this press release is included as Exhibit 99.1 to this Form 8-K.
