Item 1.04 Mine Safety—Reporting of Shutdowns and Patterns of Violations.

On October 15, 2014, the Corporation received an order issued by the Mine Safety and Health Administration (“MSHA”) under section 107(a) of the Federal Mine Safety and Health Act of 1977 at its Hunter Cement Plant in Hunter, Texas. The order stated that a scale had a broken bolt on the support under the grating which caused the platform to lean towards the exit end of the scale. The order also stated that both top bolts on the platform were bent and continued operation of the system could further damage the bolts or expose a person to a fall hazard if the platform fails due to defective bolts. No one was injured in the cited incident and the order was terminated. The Corporation took corrective action.
